College Student Dies in Apartment Murder due to Alleged Negligent Security

A 19 year old Eastern Kentucky University student was shot in the head and killed in her apartment due to negligent security, a recent lawsuit alleges. She lived at the Summit Apartment complex in Winchester, KY. Unfortunately, On 12/23/14, there was a gunfight in the apartment unit above hers. One of the stray bullets pierced the floor and hit her in the head. The sophomore in college died at the scene.

Tragically, the negligent security lawsuit alleges this kind of gun shooting could have been prevented in the apartment premises through appropriate security. This is the basis of the negligent security lawsuit. The lawsuit cites the apartment complex's duty to protect its residents from foreseeable danger and claims that crime has historically occurred in the apartment without the owners doing anything to protect residents. Specifically, the inadequate security complaint alleges the building:

  • has poor lighting which increases crimes of opportunity
  • has no barrier fence preventing trespassers from entering
  • has no access gate
  • did not perform appropriate background checks on tenants 
  • has no security cameras, and
  • has no guard patrolling the apartment premises.

The case has not yet been tried or settled as of this date.
